Your homeowner’s insurance policy may provide coverage for your Madoff losses. In order to file a claim against your homeowner’s policy, you must provide timely notice. In order to protect your rights to file a claim against your homeowner’s insurance policy, you need to provide early and advanced notice of your claim to your homeowner’s insurance carrier. Most policies have strict and onerous notice provisions that bar claims made beyond a certain limited time period. Many states “enforce” these policy limitations. 

Sonn & Erea can analyze a potential claim against your homeowner’s insurance policy in connection with your Madoff losses, but you must supply us with:

  1. A signed retainer agreement;
  2.  Your home owner’s insurance policy;
  3. Your account opening agreements with BMIS or other Fund, such as a prospectus, a Private Offering Memorandum or an Operating Agreement;
  4. The account statements you received;
  5. Any sales literature or correspondence sent to/received from Madoff or any Fund;
  6. All evidence of money you invested w/ BMIS or a Fund, such as wires, instructions;
  7. Checks or transfer of securities to BMIS or to a Fund; and
  8. Any records relating to receipt of deposit by BMIS or a Fund (it is extremely important to have proof of what entity deposited your money).
